1. Background

This Privacy Policy explains how AUTOLOGICA S.A. and AUTOLOGICA S.A.S. collect and process Personal Data. The Policy is addressed to the Customers’ users with whom we interact, including visitors or users of our websites; current and potential customers; and staff of corporate suppliers and customers; and other recipients of our services. This Policy uses the word “user” to refer to people whose Personal Data we process.

Any mention to “Autologica”, “us”, “our” or the “Company” is a reference to AUTOLOGICA S.A and AUTOLOGICA S.A.S.

The original language of this Privacy Policy is English. We may publish translations, and in case of conflict between a translation and the English version, the latter shall be valid.

The terms “Data controller” and “Data Processor” are the ones defined by the Regulation (EU) 2016/679 of the European Parliament.

This Privacy Policy applies to the following data processing activities.

Our websites may contain links to other websites, applications, and services maintained by third parties. The practices regarding the data of such services are governed by the Privacy Policies of these third parties, which we recommend reviewing.

3. Responsible Entity

AUTOLOGICA is for your Personal Data and the collection, processing, and disclosure of your Personal Data as described in this Privacy Policy unless otherwise specified.

This Privacy Policy does not apply to the extent that we offer our customers various cloud-based products and services through which our customers may sell or offer their own products and services, send electronic communications to other individuals, collect, and analyze their Personal Data, and create their own applications and websites on our platform.

4. Personal Data we collect

AUTOLOGICA S.A. and AUTOLOGICA S.A.S shall only process the data strictly necessary for the proper management of the contractual relationship and/or provision of services. They shall be exclusively those that the user has provided to the Customer.

The Personal Data we collect from the user may include the following.

  • If you express interest in obtaining information about our products and services; request technical support; complete our “Contact Us” form or similar; register to use our websites; register for a webinar or other online or on-site event; download content; or any similar activity, we will usually ask you to provide us with your contact information, such as full name, position, company name, address, phone number, email address or username and password.
  • If you make a purchase on our websites or register for an event, we may also ask you to provide us with billing information, such as billing name and address, credit card number, or bank account information.
  • If you attend an on-site event, we shall scan your attendee ID card, upon your consent, providing us with your name, position, company, address, country, phone number, and email address.
  • If you register for one of our online communities or forums, we shall ask you to provide a username, photo, and/or biographical information such as your occupation, social media profiles, company, and areas of expertise.
  • If you use and interact with our websites, we automatically collect log files and other information about your device and its use of our websites through cookies, web beacons, and similar technologies (e.g., IP addresses or other identifiers, which may qualify as Personal Data – see the section “What device and usage data we process”.)
  • If you visit our headquarters, you may need to register as a visitor and provide your name, email address, phone number, company, arrival date and time.

5. What device data backup and usage data we process

AUTOLOGICA uses common information collection tools such as logs, cookies, web beacons and similar technologies to automatically collect information, which may contain Personal Data, from your computer or mobile device while browsing our websites or interacting with emails we have sent you.

Log files

Like most websites, we collect certain information automatically through log files. This information collected may include your IP address (or proxy server), device and application identification numbers, your location, your browser type, your internet provider and/or mobile phone provider, the websites, and files you saw, your searches, your operating system and system configuration information, and the date/time stamps associated with your use. This information is used to analyze general trends and improve our websites, as well as to ensure their safety and continuous operation. We also collect IP addresses from users when they log on to our products and services as part of our regular security features.

Cookies, web beacons, and other tracking technologies

We use cookies and similar technologies, such as web beacons, tags, and JavaScript, alone or together with cookies, to collect information about the use of our websites and the interaction with our emails.

When you visit our websites, our servers or an authorized third party may place a cookie on your browser, which may collect information about your online activities over time and on different sites, including Personal Data. Cookies allow us to track general usage, determine the areas that you prefer, simplify usage by recognizing it and providing you with a personalized user experience.

We use persistent and session cookies. Session cookies only exist during a session and disappear from your computer when you close your browser or turn off your computer. Persistent cookies remain on your computer or device after you close your browser or shut down your computer.

You may control the use of cookies at the individual browser level, but if you choose to disable cookies you may limit the use of certain features of our products, services, and websites. To be excluded from tracking by Google Analytics, use the opt-out mechanism mentioned below.

We also use web beacons on our websites. For example, we may place web beacons in marketing emails that notify us when you click a link in the email that redirects you to one of our websites. Such tracking technologies are used to operate and improve our websites and email communications, and track clicks on links and email open habits.

Below, we describe how we use distinct categories of cookies and similar technologies, and the options you have to manage the data collection these technologies do.

  • Required c They allow you to browse our websites and use their features, such as access to secure areas of the sites. If you have chosen to identify yourself to us, we may place a cookie on your browser that allows us to authenticate you when you log in to the sites and process your transactions and orders online.

How to set them. As these cookies are essential to operate our websites, there is no option to opt out of these cookies.

  • Functionality cookies. They allow us to remember the information you enter or the choices you make (such as username, language, region) and provide you with better and more personalized functionality. They may also be used to improve the functioning of our websites and to help us provide you with more relevant messages, including marketing communications. These cookies collect information about how our websites are used, including the most frequently viewed pages. We may use our own technology or third-party technology to track and analyze usage and volume statistical data to provide enhanced interactions and more relevant communications, and to track the performance of our advertisements. We use Google Analytics in particular as our data processor, a web analytics service provided by Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.   • Advertising cookies. Sometimes we use cookies supplied by us or by third parties to show you advertisements for our products that we think you may be interested in, on any device you may use, and to track the performance of these advertisements. These cookies may collect and remember information, such as which browsers have visited our sites. The information we may provide to third parties does not include Personal Data, but this information may be re-associated with Personal Data after it is received. We may also work with third-party advertising networks that collect IP addresses and other web beacon information on our websites, from emails and on third-party websites. Advertising networks track online activities over time and on different sites and online services by collecting device data backup and usage data through automated means, including cookies. These technologies can recognize you through the different devices you use, such as a computer, mobile or tablet. Third parties use this information to provide advertisements for products and services tailored to your interests. As described in this policy, we or a third party may place or recognize a unique cookie on your browser when you visit our websites, in order to provide you with targeted advertising (also known as “interest-based advertising”). Exclusion from device and usage data collection

You may opt-out of device data backup and usage data collection (see section ” What device data backup and usage data we process”) by managing your cookies at your personal browser level. Please note that by blocking or deleting cookies and similar technologies used on our websites, you may not be able to take full advantage of the website.

Even though some browsers offer a “Do Not Track” or “DNT” option to indicate websites that you do not want them to track your online activities, these characteristics are not yet uniform and there is no common standard adopted by industry clusters, technology companies or regulators. Therefore, we do not currently undertake to respond to browser DNT signals regarding our websites. Autologica takes privacy and your wishes in this regard very seriously, so we monitor developments regarding DNT technology and the implementation of standards.

Social Media Features

Our websites may use social media features, such as the “Like” button on Facebook, the “Tweet” button, and other similar widgets used for sharing (“Social Media Features”.) These Social Media Features may offer you the option of posting information about your activities on a profile page provided by a social media, which will be shared with others within that network.

Social Media Features are hosted by the respective social networks or directly on our website. In the first case, the respective social media may receive information that you have visited our website from your IP address. If you are logged in to your social network account, the respective social media may be able to link your visit to our websites to your social media profile.

Autologica may also allow you to log in to some of our websites using login services such as Facebook Connect. These services will authenticate your identity and give you the option to share certain Personal Data with us, such as your name and email, to auto-complete any of our forms (subscription, log-in, or other.)

Your interactions with the Social Media Features are governed by the privacy policies of the companies that provide the relevant Social Media Features.

Telephony log information

If you use certain Autologica services, we shall also collect telephony log information (such as phone numbers, call time and date, call duration, SMS routing information, and call types), device event information (such as crashes, system activity, hardware configurations, browser language), and location information (such as IP address, GPS and other sensors that can, for example, provide us with information about nearby devices, Wi-Fi hotspots and telephone towers.)

6. Reasons why we process Personal Data

We collect and process your Personal Data for the purposes explained below.

  • To provide our products, services, and websites. We shall process your Personal Data to the extent necessary for the performance of our contract with you regarding the use of our products, services, and websites, and to comply with our obligations under the applicable terms of use. If we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to operate and manage our websites and to provide you with the content you access and request (for example, downloading certain content from our websites.)
  • To promote the security of our websites. We shall process your Personal Data by tracking the use of our websites, creating aggregated and non-personal data, verifying accounts and activities, investigating suspicious activities, as well as application and violations of our terms and policies, to the extent that this is necessary for the purpose of our legitimate interests in promoting the security and protection of the systems and applications used for our websites, and the protection of our rights and those of others.
  • To manage user registration. We shall process your Personal Data by managing your user account for the purpose of fulfilling the contract with you in accordance with the applicable terms of service.
  • To manage contact and support requests. If you complete a “Contact Me” web form, request technical assistance, or contact us by other means, we shall process your Personal Data for the performance of our contract with you and to the extent necessary for the purpose of our legitimate interests to fulfill your request and communicate with you.
  • To manage registration and attendance to online and on-site events. We shall process your Personal Data to plan and organize the event, including communication with you, depending on the performance of our contract with you.
  • To manage your payments. If you have provided us with financial information, we shall process your relevant Personal Data to verify your financial rating and charge you in order to fulfil the contract concluded with you.
  • To develop and improve our websites. We shall process your Personal Data to analyze trends, track your use of our websites and interactions with emails, to the extent that this is necessary for our legitimate interest in developing and improving our websites and providing our users with more relevant and interesting content.
  • To manage visitors to our headquarters. We shall process your Personal Data for security reasons, to record who visits our headquarters.
  • To display advertising and custom content. We shall process your Personal Data to conduct market research, show you advertising, provide you with personalized information about Autologica on and off our websites, and show you other custom content based on your activities and interests, to the extent necessary for our legitimate interest in advertising our websites or, where necessary, to the extent that you have provided your prior consent separately (see “Your rights regarding your Personal Data” section to see how to control how Autologica processes your Personal Data for commercial purposes.)
  • To send marketing communications. We shall process your Personal Data to send you marketing information, product recommendations and other non-transactional communications (such as newsletters, SMS messages and push notifications) about Autologica, including information about our products, promotions, or events. as required by our legitimate interest in direct marketing or to the extent that you have provided your prior consent separately (see “Your rights regarding your Personal Data” section to see how to control how Autologica processes your Personal Data for commercial purposes.)
  • To comply with legal obligations. We shall process your Personal Data when we cooperate with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws, to the extent that this requires the processing or disclosure of Personal Data to protect our rights, and is necessary for our legitimate interest to protect against misuse of our products, services and websites, to protect personal property or security, to seek possible solutions and limit our damage, to comply with court proceedings, court orders or legal processes, and/or to respond to legal requests.

When we need to collect and process Personal Data in order to comply with the law, or under a contract that we have entered into with you and for which you have not provided the required Personal Data when requested, we may not be able to perform the contract.

  1. Legitimation for the processing of Personal Data

Users give their consent in accordance with the current regulations, law N° 18.831 (Eastern Republic of Uruguay) and law N° 25.326 (Argentine Republic), for the treatment of their data in compliance with a service contract with the Customer. You have the right to withdraw your consent at any time by notifying your decision to AUTOLOGICA S.A. or AUTOLOGICA S.A.S.

8. With whom we share Personal Data

We may share your Personal Data with the following addresses.

  • Our contracted service suppliers providing services such as system management and hosting, credit card processing, research and analysis, marketing, customer support, and data enrichment.
  • If you attend an online or on-site event organized by AUTOLOGICA, we may share your information with event sponsors if: (1) You agree to share your data on the event registration form; or (2) You allow your attendance credentials to be scanned at an exhibitor stand. In these cases, your information shall be subject to the privacy policy of those third parties. If you do not want your personal data to be shared, you may choose not to authorize it when you register for the event, and/or not to allow your credentials to be scanned at our events.
  • If we engage in a merger or reorganization, or if all or part of our business is acquired by another company, we shall transfer part or all of your Personal Data to that third party. In accordance with applicable laws, we shall make every reasonable effort to notify you of such transfer of Personal Data.
  • Any personal information you choose to send to communities, forums, blogs, or chat rooms on our websites may be read, collected, and used by others visiting these forums, depending on your account settings.
  1. International transfer of information collected

Your Personal Data may be collected, transferred, and stored by us in the United States, in Uruguay, and in other countries where we operate. If you are located in the EEA, your Personal Data may be processed in countries which are not subject to European Commission regulations and which may not provide the same level of data protection as in the EEA. By using our products, services, and websites, you grant us a general authorization within the meaning of Article 28 (2) of Regulation (EU) 2016/679 to contract processors (data processors) for the purpose of providing our products, services, and websites.

10. Children

Our products, services, and websites are not intended for children. We do not knowingly collect Personal Data from children under 16. If you are a parent or guardian and believe that your child has provided us with Personal Data without your consent, please contact us as described in the “How to contact us” section and we shall take steps to remove this Personal Data from our systems.

11. How long we store your Personal Data

We shall retain your Personal Data for a period of time that is consistent with the original purpose of the collection (see the “Reasons why we process Personal Data” section.) We determine the appropriate retention period for Personal Data based on the amount, nature, and sensitivity of your Personal Data, the potential risk of harm from unauthorized use or disclosure, and whether we can achieve the purposes of processing through other means as well as the applicable legal requirements (e.g., applicable statutes of limitation.)

After expiry of retention periods, your Personal Data shall be deleted. If there is any information that, we cannot completely remove from our systems for technical reasons, we shall implement appropriate measures to prevent further use of that data.

12. Your rights regarding your Personal Data

Your rights

Access

Users shall have the right to obtain confirmation from the data controller of whether the data concerning them are being processed or not, as well as detailed information about certain aspects of the processing being conducted, prior accreditation of their identity.

 

Rectification, suppression, and update

Proving their identity, users can request the information that AUTOLOGICA S.A. and AUTOLOGICA S.A.S. possess. Users can also request that their personal data included in a database be rectified, updated, and even deleted, when any error, falsity or exclusion is found in the information held by them in accordance with current legislation.

We inform you that you have the right to withdraw, at any time, the consent granted for a specific purpose, without affecting the lawfulness of the processing, based on the prior consent to its withdrawal.

How to exercise your rights

To exercise your rights, contact us as indicated in the “How to contact us” section, indicating the right you wish to exercise and providing a copy on both sides of your personal ID or other equivalent document certifying your identity and of the person representing you, if applicable. We try to respond to all legitimate requests within 30 days and shall contact you if we need additional information to fulfill your request. We try to resolve requests within 60 days. Occasionally, it may take longer depending on the complexity and/or number of requests we receive. If you are an employee of an Autologica customer, we recommend that you contact your company’s system administrator to help you correct or update your information.

In addition, if you have registered for an account with us, you can usually update your user settings, profile, company settings, event registration information and other data by logging into the corresponding product, service or websites using your username and password and editing your personal settings.

To update your billing information, discontinue your account and/or request the return or deletion of your Personal Data and other information associated with your account, please contact us.

Furthermore, if you understand that your rights have not been adequately addressed, we inform you that current legislation provides for your right to file a complaint with a supervisory authority.

Your rights related to customer data

Autologica shall also process Personal Data with the role of data processor (see “Responsible Entity” section). If your Personal Data has been sent to Autologica by one of our customers, and you wish to exercise any rights you may have under applicable data protection laws, please direct your inquiry directly to our customer. We can only access our customers’ data by following the instructions of the respective customer. If you want to make your request directly to us, please provide the name of the Autologica customer who sent us your data. We shall forward your request to that customer and provide all necessary support to respond to your request within a reasonable time.

Your preferences for marketing communications

If we process your Personal Data to send you marketing communications, you may manage the reception of non-tradable commercial communications by clicking on the “Unsubscribe” link (or similar) located at the bottom of our marketing emails, answering or texting ‘STOP’ if you receive SMS messages, or turning off push notifications from our applications on your mobile device. You may also contact us to unsubscribe (see the “How to contact us” section.) The exclusion of marketing communications shall not prevent you from receiving important commercial communications related to your current relationship with us, such as information about the products and services you use, registration to events, service announcements, security information, and similar information.

Security

We take precautions that include organizational, technical, and physical measures to protect against destruction, loss, alteration, unauthorized disclosure, or unauthorized or accidental access to the Personal Data we process or use.

Even though we follow accepted standards to protect Personal Data, no method of storage or transmission is 100% secure. You are solely responsible for protecting your password, limiting access to your devices, and logging out from our products, services, and websites at the end of your sessions. 12. Changes to this Privacy Policy

AUTOLOGICA S.A. and AUTOLOGICA S.A.S undertake to notify users of any changes to the privacy policy and to provide them with the opportunity to review and accept changes prior to their entry into force.
